Terms of Business Agreement (‘TOBA’)

Who we are

Our Insurance Services

We offer a Flight Delay Benefit insurance product from a single insurer. 

We will:

  • In respect of sales, provide you with factual information about the protection this insurance and its additional coverage options provide, including its price.
  • Provide you with indicative insurance quotes.
  • Secure insurance cover for you on your instructions, and
  • Arrange for the administration of your insurance policy and invoicing of insurance premium.

You will not receive advice or a recommendation from us in relation to the insurance products we offer. You are entirely responsible for deciding whether or not to purchase the insurance product.

In obtaining indicative quotes and securing insurance on your behalf, we work with Companjon Services UK Branch (‘Companjon’), financial register number 970465, which is an Appointed Representative of Advent Solutions Management Ltd authorised and regulated by the Financial Conduct Authority under financial register number 308751.  Companjon acts as agent of Stonebridge International Insurance Ltd, company registration number 3321734, which insures all policies transacted under this agreement. Stonebridge International Insurance Limited is an unrated insurance company, however this does not impact your rights to complain to the Financial Ombudsman Service or seek compensation via the Financial Services Compensation Scheme (FSCS)

Product Documentation

You should review the policy documents carefully to ensure they accurately reflect the cover, conditions, limits, and other terms that you require. Particular attention should be paid to policy conditions and warranties as failure to comply with these could invalidate your policy. Claims can arise, under certain types of insurance contract, for a period after the expiry of the policy. It is therefore important that you retain and keep safely all documents associated with your policy.

Demands and Needs Statement

The insurance product which we distribute meets the demands and needs of those travelling who wish to be compensated for any delay to a flight from 30 minutes after the scheduled departure time for a maximum compensation of up to 90th minute of a delay.  It is important for customers to note that the trigger for payment under the policy, and consequently, what matters to calculate the compensation, is the delay to the actual departure time of your flight, defined as the aircraft push off from the departure gate, and not whether your arrival at the destination is delayed.

Confidentiality

Each party will treat information received from the other relating to this agreement as confidential and will not disclose it to any other person not entitled to receive such information except as may be necessary to fulfil their respective obligations in the conduct of the insurance business or as may be required by law or a regulatory authority.

Law and Jurisdiction

These terms of business shall be governed by and construed in accordance with English law. In relation to any legal action or proceedings arising out of or in connection with these terms of business we both irrevocably submit to the non-exclusive jurisdiction of the English courts.

Fees and charges

We do not usually make other charges over and above the premiums charged by insurers.

Our Earnings

You are entitled at any time to request information regarding any commission which we may have received as a result of placing your insurance business with the insurer.
